The victim suffered an anoxic brain injury, resulting in permanent impairment characterized by intentional myoclonus, which a condition that left the plaintiff with near constant tremors, shaking and jerks, any time he moves his body.

    Defendants contended that nothing the residents, physicians or hospital staff did or failed to do would have prevented the outcome. They also argued that even if Jane had been timely treated, she would be in the same condition that she finds herself today. In support of that position, the defendants collectively argued that Jane’s quadriplegia was complete as of the time that she arrived at Valley Hospital. Further, they argued that emergent surgery on June 9th would not have prevented the outcome as Jane had already infarcted her spinal cord.

    Our client was the daughter of a 64-year-old woman who suffered a stroke and was admitted to a nursing home with inability to speak, move the right side of her body, or care for herself, such that she was completely dependent on others for all of her needs.
